Chapter 28 of RF Criminal Code

Ignorance of the law is no excuse

Dear users, please remember this. Prior to effecting any action pertaining to computer systems (LAN, Internet etc.) think of the relevant consequences and further results. Given below is Chapter 28 of the RF Criminal Code to facilitate such thoughts.

1. Unauthorized access to computer information protected by law, i.e. information on computer medium, in resulted in destroying, blocking, modifying or copying information, breaking the operation of computers, computer systems or their networks, is punished by a penalty in the amount of two hundred to five hundred minimum wages or in the amount of the wage or other income for a period from two up to five months of the convicted, or compulsory labor for a period from six months to one year, or imprisoning for a period up to two years.

2. The same action effected by a group of persons or by previous concert, or by a organized group or a person using his (her) job or granted access to computers, computer systems or their networks is punished by a penalty in the amount of five hundred to eight hundred minimum wages or in the amount of the wage or other income for a period from five up to eight months of the convicted, or compulsory work for a period of one year to two years, or arrest for a period of three to six months, or imprisoning for a period of up to five years.

Article 273. Creation, usage and distribution of harmful computer programs

1. Creation of computer programs or modification of the existing programs wittingly resulting in unauthorized destroying, blocking, modifying or copying information, breaking the operation of computers, computer systems and their networks, as well as using or distributing such programs or computer mediums with such programs, is punished by imprisoning for a period of up to three years with a penalty of two to fife minimum wages, or in the amount of the wage or another income of the convinced for a period of two to five months.
2. Те же деяния, повлекшие по неосторожности тяжкие последствия, - наказываются лишением свободы на срок от трех до семи лет.

Статья 274. Нарушение правил эксплуатации ЭВМ, системы ЭВМ или их сети

1. Нарушение правил эксплуатации ЭВМ, системы ЭВМ или их сети лицом, имеющим доступ к ЭВМ, системе ЭВМ или их сети, повлекшее уничтожение, блокирование или модификацию охраняемой законом информации ЭВМ, если это деяние причинило существенный вред, - наказывается лишением права занимать определенные должности или заниматься определенной деятельностью на срок до пяти лет, либо обязательными работами на срок от ста восьмидесяти до двухсот сорока часов, либо ограничением свободы на срок до двух лет.

2. То же деяние, повлекшее по неосторожности тяжкие последствия, - наказывается лишением свободы на срок до четырех лет.
